Introduction and condition of use:

Please read these terms and conditions (“terms and conditions”, “terms”) carefully before using succeedingtogether.online website (“website”, “service”) operated by Samantha Bailey, luisa Greig, Claire Warman, Emma Johnston, Emma Byrnes, Daniella Stewart, Amy thomson (“us”, ‘we”, “our”).

By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website accordingly. We only grant use and access of this website, its products, and its services to those who have accepted its terms.

Age restriction

You must be at least 18 (eighteen) years of age before you can use this website. By using this website, you warrant that you are at least 18 years of age, and you may legally adhere to this Agreement. We assume no responsibility for liabilities related to age misrepresentation.

Right to make changes to the agreement

We reserve the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between us and the user, and this supersedes and replaces all prior agreements regarding the use of this website.

Purpose

The purpose of Succeeding together is to:

a. Create a multi model network for members to have access to general advice from our professionals

b. To provide regular talks for our members on various subjects within the professional’s own modality

c. To encourage understanding and ethical standards when choosing a professional to work with

User Accounts

As a user of this website, you are asked to register with us and provide private information, including card details that we do hold. They are held by Paypal or Stripe. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password.

If you think there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.

Only one account can be set up in your name and we reserve the right to cancel an additional account set up in your name under a different email address.

We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.

Two types of membership

a. Members- for members of the public to have access to weekly Q&A’s, regular online talks and in person on a less frequent basis, content of the website and access to the private Facebook group

A minimum of 1 months sign up.

Payment taken 30 days after signing up begins and continues until the client cancels via the website or requests cancellation via email

Refunds will not be given to members who decide to leave the group on their own accord or those that breach these terms and conditions except where the admin deem necessary.

Professionals. Currently no contract in place and a professional can leave at any time.

Privacy policy and data protection Before you continue using our website, we advise you to read our privacy policy [link to privacy policy] regarding our user data collection. It will help you better understand our practices.

Bullying and Harassment

Bullying and Harassment is strictly prohibited. If we have evidence that any member or group of members or professional is bullying another member of the group, they will be removed, pending investigation.

a. Harassment:
Members who harass other members will have their membership cancelled. No refund will be offered. Harassment includes but is not limited to:

i. Sending unsolicited private messages

ii. Blocking admins or moderators

iii. Spamming social media groups or networks with inappropriate

iv. Stealing or using content created

Confidentiality

a. Members and professionals will respect the confidentiality of everyone.

Anonymising posts using confide in fido

ii. Keeping information shared within the group by other members seeking support or guidance confidential.

iii. Never ‘Screen-shooting’ posts from within the group and sharing these either publicly or privately.

Payment terms

Use of third part PayPal and stripe to collect subscription payments on an automatic monthly basis and one off payments

Refunds of subscription or one of service

No refunds are offered except in extenuating circumstances. By agreeing to these terms and conditions your statutory rights are not affected. Should we decide to waive any of these terms on an individual basis, this shall not affect the validity of remaining clauses or commit (all our names) to waive the same clause on any other occasion. For one off payments no refunds are given after the launch date of the product or service has commenced.

Termination of accounts/service

We reserve the right to cancel the subscription of membership to any member (at any time & with immediate effect) if these terms and conditions are breached. We reserve the right to change the terms and conditions at any time giving the membership 30 days’ notice. The decisions of the data controller Samantha Bailey are final.

You can terminate your subscription at any time by logging into the website and going to subscriptions on your account page. Once you terminate your subscription you will also be removed from the Facebook group and loose access to the content on the website. You can re-join at any time by reactivating your subscription. The exception for not being able to re-join is for any rule breaches.

Copyright and intellectual property

You will not copy and paste another professionals’ or members content and use it as your own. All blogs written on your pages/website should be in your own words or if using someone else’s material quoted and referenced.

You agree that all materials, products, and services provided on this website are the property us and its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute our intellectual property in any way, including electronic, digital, or new trademark registrations.

You grant us a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company to come to an agreement.

Governing law

By visiting this website, you agree that the laws of the England and Wales without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between us and you, or its business partners and associates.

Limitation of liability

We are not liable for any damages that may occur to you as a result of your misuse of our website, webinars, talks (online and in person), Facebook group and all other services offered.

You agree to indemnify Samantha Bailey, Lusia Greig, Claire Warman, Emma Johnston, Emma Byrnes, Daniella Stewart, Amy thomson and its affiliates and hold us harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Samantha Bailey, Fiona Firth, Claire Warman, Michelle Phillips, Emma Johnston, Emma Byrnes, Daniella Stewart, Amy thomson shall have no liability under any circumstance whatsoever to the client for financial loss or loss of profit and will not be held responsible under any circumstances, including any result of using the website or any of our services. In no event will we be liable to the client or any third party for damages or losses or be liable for any loss, injury, or liability to the client. It is the client’s responsibility to inform third parties of any possible risk.

Disputes

Any dispute related in any way to your visit to this website or to products you purchase from us shall be arbitrated by court in England and Wales and you consent to exclusive jurisdiction and venue of such courts.

Complaints

All complaints must be made in writing and submitted by e-mail to Samantha bailey. The complainant will give their full name, contact telephone number, e-mail address (if available) and postal address. Full contact details will be requested if not initially provided. Failure to provide satisfactory information will render the complaint null and void. Anonymous complaints will be disregarded.

The complaint will be logged. Membership status of the individual to which the complaint has been raised will be checked and if found not to be a member or professional the complainant will be informed that no action can be taken by Samantha Bailey.

Samantha Bailey will contact the complainant by telephone, e-mail, or letter to ascertain the exact terms of the complaint. The precise details of the complaint will be ascertained and documented and submitted to the complainant for agreement.

If the complainant advises of independent parties who may be able to support the complaint, the validity of this will be checked by Samantha Bailey.

If the complainant supplies names and contact details (telephone number, e-mail address and postal address) of those independent parties referred to above then they will be contacted in writing by Samantha Bailey. Failure to provide contact details will mean no contact will be made.

Samantha Bailey will contact the member in writing (e-mail, postal) and explain the terms of the complaint, including the name of the complainant and witnesses if appropriate and will forward copies of all relevant documentation to the member by either e-mail or recorded delivery. The member will not be asked to respond until in possession of this.

The member will be asked to submit a written response to the allegations within 14 days of receipt. Extensions to this may be granted at the discretion of the Samantha bailey.

Samantha Bailey will consider the member’s written response and, if deemed reasonable, no further action will be necessary and both parties will be informed in writing.

In the eventuality that Samantha Bailey does not consider that the member’s written response is reasonable then the member will be informed in writing. Negotiation with the complainant and member may be appropriate to reach a satisfactory resolution of the complaint.
